Acceptable Use Policy (AUP).

1. Purpose and Scope
This Acceptable Use Policy (“AUP”) governs the use of VibeCart, a platform provided by Trebbble S.A.. To ensure the reliability of our messaging services and compliance with both Greek and international regulations, all Merchants must adhere to these standards. Your use of VibeCart constitutes agreement to this AUP and the messaging policies of our sub-processors, including MSTAT, Apifon, and Yuboto.
2. Mandatory Consent & Data Privacy
In alignment with our Privacy Policy and the GDPR, VibeCart is a permission-based service.
Merchant Responsibility: As the Data Controller for your end-customers, you are solely responsible for obtaining explicit, affirmative marketing consent before sending any messages.
Prohibited Lists: You may not use, upload, or sync any data purchased from third parties or scraped from the web.
Proof of Opt-In: You must maintain records of how and when marketing consent was obtained. Trebbble S.A. reserves the right to request this proof to verify compliance with Greek Law 4624/2019.
3. Messaging & Industry Restrictions
To protect the delivery reputation of our infrastructure, you are prohibited from using VibeCart to transmit content related to:
Illegal Acts: Any content that violates Greek or EU law.
High-Risk Industries: Debt collection, multi-level marketing (MLM), unlicensed gambling, or the sale of regulated substances (e.g., cannabis/CBD).
Deception: Phishing, social engineering, or misleading headers intended to hide the sender's identity.
Harassment: Content that is defamatory, obscene, or promotes violence.
4. Anti-Spam & Operational Standards
Immediate Sync: Once a recipient withdraws consent, you must ensure they are removed from all future VibeCart campaigns immediately.
Spam Thresholds: Accounts that generate high "Spam Report" rates from users on WhatsApp or Viber will be subject to immediate review and potential suspension.
5. Technical Integrity & Security
You agree not to:
Interfere with the secure APIs used to connect VibeCart to e-commerce platforms like Shopify, WooCommerce, or Magento.
Attempt to bypass our security measures or encryption protocols (TLS/SSL).
Use bots or automated scripts to scrape data from the VibeCart CMS.
6. Regulatory Monitoring (ADAE Compliance)
Please be advised that in accordance with the Hellenic Authority for Communication Security and Privacy (ADAE) guidelines, Trebbble S.A. retains logs of messages sent (sender, recipient, and timestamp) for a period of 24 months. These logs are maintained for regulatory compliance and may be disclosed if required by valid legal process.
7. Enforcement and Termination
Failure to comply with this AUP may result in:
Immediate suspension or termination of your VibeCart account.
Reporting of illegal activities to the Hellenic Data Protection Authority (HDPA) or other relevant law enforcement agencies.
Loss of all subscription fees; as stated in our Terms, violations of the AUP forfeit any right to a refund.
8. Governing Law and Jurisdiction
This AUP is governed by the laws of Greece. Any disputes arising from the enforcement of this policy shall be subject to the exclusive jurisdiction of the Courts of Athens.
